The Three Paradigms of Independent Contractors - Goals, Qualification, Services
An “Independent Contractor” is a person, business, or legal entity that provides goods or services to another person or business under terms in an oral or written contract. Very often, independent contractors are self-employed persons (i.e. attorneys, architects, consultants, etc.) who provide certain services to a business (or client or owner).
“I much appreciate the clear and concise advice in a very straight forward business communication style! Shawn is a fountain of business knowledge that he can couple with his legal expertise to communicate with the business world as well as the public at large.” G.M.
By their definition, an independent contractor is not under the direct control, guidance, or influence of the business or client. In most areas, to be legally designated as an independent contractor, the person or business must (1) be free from the direct control of the client, (2) be able to exercise their independent judgment as to the manner/methods to accomplish the end-result, and (3) be responsible for their full performance under the terms of the contract.
“I appreciate your ability to help me quickly clarify legal issues and to guide me toward a negotiated settlement. You have helped me avoid making decisions that escalate a problem while keeping an eye on the bigger picture of solving problems." A.H.
The “Three Paradigms” of Independent Contractors are “Goals, Qualifications, Services”. The person or business who engages an Independent Contractor should have specific “Goals” in mind and make sure that the independent contractor possesses the appropriate “Qualification” in order to properly deliver the goods or “Services” as required in the independent contract.
